II. Terms and Conditions
These Terms and Conditions (“Terms”) govern your access to and use of the website, mobile applications, and services (collectively, the “Services”) operated by Doveway LLC. By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, our Community Safety & Delivery Guidelines, and our Arbitration Agreement and Governing Law provisions below. If you do not agree, you must not use the Services.
1. Description of the Platform
The Company provides an online platform that connects individuals who wish to send items (“Senders”) with individuals willing to transport those items (“Travelers”) to the same international destination they were already heading. The Company only provides a technology platform that facilitates connections between users. It is not a courier service, freight carrier, shipping provider, or logistics company, and does not transport, store, or take possession of any items.
Users may not send or transport items with a declared or actual value exceeding $1,000 (or another limit as configured by the Company). All agreements and arrangements occur directly between users, facilitated by the Platform. The Company does not inspect packages, supervise deliveries, or take possession of transported items. Users remain fully responsible for their actions and compliance with applicable laws and regulations.
2. Eligibility
To use our Services, you must:
- Be at least 18 years old
- Have a permanent residence address in the United States of America
- Provide accurate and truthful account information
- Comply with all applicable laws and regulations
The Company reserves the right to suspend or terminate accounts that violate these Terms.
3. User Accounts
Users may be required to create an account to access certain features. You agree to:
- Provide accurate and current information
- Maintain the confidentiality of your login credentials
- Notify us immediately of any unauthorized use of your account
You are responsible for all activities conducted in your account.
4. Independent Contractor and No Agency Relationship
Users of the Platform act independently. Nothing in these Terms creates any partnership, joint venture, agency, franchise, employment, or fiduciary relationship between the Company and any user. Travelers and Senders operate independently and directly with each other. The Company does not supervise, control, or direct users and does not control how or whether any delivery is completed.
5. Platform Neutrality
The Company provides a neutral online platform for users to connect. The Company:
- does not own or operate transportation services
- does not inspect or handle packages
- does not guarantee delivery of items
- does not participate in agreements between users
While the Company may facilitate payments through a third-party payment processor, it is not a party to the underlying agreement between Senders and Travelers, and does not provide transportation, shipping, or delivery services. The agreement for the transport of items exists solely between the Sender and the Traveler.
6. User Responsibilities
Users are solely responsible for:
- the contents of any items transported
- compliance with all applicable laws
- packaging items safely and appropriately
- ensuring items are legal to transport across borders
Travelers are responsible for determining whether they are legally permitted to transport items through airlines, customs authorities, and local regulations.
7. Prohibited Items
Users may not send or transport items that are illegal, restricted, or dangerous, including but not limited to:
- Illegal drugs or controlled substances
- Weapons, firearms, or ammunition
- Explosives, flammable materials, or hazardous/toxic substances
- Counterfeit or stolen goods
- Live animals
- Perishable food items
- Cash or currency
- Precious metals, gemstones, or high-value jewelry without proper documentation
- Government-issued identification documents (passports, IDs, etc.)
- Any item prohibited by customs authorities, airline regulations, or international shipping laws
The Company does not inspect or verify packages, and shall not be responsible for any criminal, civil, or regulatory consequences arising from the transport of prohibited goods. Users agree to waive any and all liability against the Company for customs seizures, fines, legal penalties, or investigations resulting from user activities. The Company may remove listings or suspend accounts suspected of violating these restrictions.
8. Payments and Fees
The Platform may facilitate payments through third-party payment providers. Users agree to comply with the terms and policies of the payment processor. The Company charges service fees or transaction fees for use of the Platform and is not responsible for payment disputes between users except as required by law.
9. Cancellations and Returns
Whether a delivery can be cancelled, what is refunded, and who pays to return a package depend on how far the delivery has progressed. These rules are set out in full in our Cancellation & Return Policy, which forms part of these Terms.
10. Disputes Between Users
The Company is not responsible for disputes between users, including disputes involving lost items, damaged items, delivery delays, or misrepresentation of items. Users agree to attempt to resolve disputes directly. The Company may assist in dispute resolution at its sole discretion but is not obligated to do so.
11. Ratings and Reviews
Users may leave ratings and reviews regarding their experiences with other users. Reviews must be truthful and may not contain defamatory statements, harassment or threats, or false information. The Company reserves the right to remove reviews that violate these rules.
12. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost or damaged items, delivery failures, user misconduct, customs delays or seizures, or financial losses resulting from transactions. The Company's total liability shall not exceed the greater of the amount paid to the Company in the previous 12 months, or $100 USD.
13. Indemnification
Users agree to indemnify and hold harmless the Company and its affiliates from any claims, damages, liabilities, or expenses arising from items transported through the Platform, violation of laws or regulations, disputes between users, misuse of the Services, or violation of these Terms.
14. Suspension and Termination
The Company may suspend or terminate accounts if users violate these Terms, engage in fraudulent activity, use the Platform for illegal purposes, or pose a risk to other users or the Platform. Termination may occur without prior notice where necessary.
15. Intellectual Property
All software, content, trademarks, and branding associated with the Platform are the property of the Company or its licensors. Users may not reproduce, distribute, or modify Platform content without written permission.
16. Privacy
Your use of the Services is governed by our Privacy Policy, which explains how personal information is collected and used.
III. Community Safety & Delivery Guidelines
Our platform is designed to connect individuals who want to send items with travelers who are willing to transport them. These guidelines help ensure a safe, secure, and trustworthy experience for everyone. All users must follow these guidelines in addition to our Terms and Conditions and Privacy Policy. Failure to follow these rules may result in account suspension, removal from the platform, or reporting to authorities where required by law.
Senders' Responsibilities
- Verify Traveler Identity: Before arranging a delivery, confirm that the traveler has completed identity verification. Look for the verified badge on the traveler's profile and review their ratings and reviews when available. Only work with travelers who have successfully completed our verification process.
- Use Secure Payment Methods: All payments must be made through the platform's secure payment system. Payments are held in escrow until delivery is confirmed. Never send money directly to travelers outside of the platform. Payments made outside the platform are not protected, increase the risk of fraud, and violate our Terms of Service.
- Package Documentation: Clearly describe all items being sent. Before packaging, take clear photos of the items, provide an accurate description, and declare the approximate value of the package. Prohibited or restricted items must never be listed or shipped through the platform.
- Secure Packaging: Use secure packaging materials and avoid packaging items that are fragile unless properly protected. The platform is not responsible for damage caused by improper packaging.
- Communication Guidelines: Use the platform's in-app messaging system for all communication and avoid sharing personal contact information. Report suspicious behavior, fraudulent activity, or safety concerns immediately through the platform.
- Compliance With Travel and Customs Regulations: Senders are responsible for ensuring that any item they transport complies with airline baggage policies, airport security rules, customs regulations, and import/export laws. Failure to comply may result in fines, confiscation of items, or legal consequences. The platform is not responsible for customs inspections, delays, or seizures.
Travelers' Responsibilities
- Complete Identity Verification: Travelers must complete identity verification before accepting delivery requests. The Company reserves the right to request additional verification if necessary.
- Verify Package Contents: Before physically accepting a package from a sender, confirm that the package contents match expectations, ask questions if the description is unclear, verify that the contents comply with airline, customs, and platform rules, and refuse packages that appear suspicious or improperly documented. Never accept and travel with packages you have not reviewed or cannot verify. If you suspect illegal or dangerous items, decline the request and report it immediately.
- Compliance With Travel and Customs Regulations: Travelers are responsible for ensuring that any item they transport complies with airline baggage policies, airport security rules, and customs regulations. The platform is not responsible for customs inspections, delays, or seizures.
- Secure Handling of Packages: Handle packages with care and keep them secure at all times. Packages should remain in the traveler's possession during the entire trip and should not be transferred to third parties other than the recipient. Take reasonable precautions to prevent loss, theft, or damage.
- Delivery Confirmation: Confirm delivery only after the recipient has received and inspected the package, using the platform's delivery confirmation tools.
IV. Reporting Safety Issues
If you encounter suspicious behavior, illegal activity, or safety concerns, please report it immediately through the platform or by emailing doveway.tech@gmail.com. Reports are reviewed by our safety team and may result in account investigation, suspension, or removal from the platform.
V. Changes to Terms of Service
We may update these Terms of Service from time to time to reflect changes in our practices, technology, legal requirements, or business operations. When updates occur, we will revise the “Last updated” date at the top of this page. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
VI. Arbitration Agreement
Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration, rather than in court. Arbitration shall be conducted on an individual basis, and users waive the right to participate in class actions or class arbitration. This provision does not prevent either party from bringing claims in small claims court where permitted by law. The party initiating arbitration shall be responsible for filing fees and administrative costs, provided that the arbitrator may reallocate such fees and expenses in the final award as permitted by applicable law.
VII. Governing Law
These Terms shall be governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles.
